Dr. John V. Murray, Jr., MD of Radiology Specialists of Florida violated Federal HIPAA laws by sending patients Protected Health Information (PHI) including detailed test results to an insurance company!

Dr. John V. Murray, Jr., MDWhat is worse is that neither did the insurance company need nor even ask for the test results! HIPAA laws state quite clearly that doctors are required to send only the minimum documentation required for billing, meaning all they need to send is the bill. What kind of doctor sends a patients private test results when not only is it not required, but against the law?

Because this type of violation is so serious, The US Department of Health and Human Services Office for Civil Rights (OCR) provides stiff Civil and Criminal penalties including imprisonment. In fact, the Depart of Justice investigates these type of issues. (42 USC ยง 1320).

What did Dr. Murray do when he was contacted about this very serious matter? Did he apologize and try to makes things right? No. Dr. Murray ignored this serious matter. Apparently Dr. Murray feels he is above the law and does not have to protect patients private medical records.

Thats very unfortunate Mr. Murray chose to bury his head in the sand and not address this very serious HIPAA violation.

But surely the head of administration for the practice
Warren Wylie of Radiology Specialist of Florida
would address this serious matter, right? Wrong.

While Mr. Wylie acknowledged he received a letter bringing to his attention Dr. Murray's HIPAA violations, he did not respond to the letter. Instead, Warren Wylie went on vacation a week later without responding to the letter and to date still has not responded, which begs the question:

Are Warren Wylie and Dr. Murray conspiring to cover-up Federal HIPAA Violations?

This matter will be explored here in depth in the coming weeks and months, but in the interim, if you want to make sure your private medical records are not unlawfully sent to 3rd parties which could cause irreparable damage to you, think twice about John V. Murray, Jr., MD and Radiology Specialists of Florida.
